General Disclaimer

 Participation in Rugged Recess is voluntary and all attendees, vendors, contractors, and organizations involved must comply with the terms, policies, and applicable laws.

• "Rugged Recess" Rugged Entertainment LLC reserves the right to amend or update policies at any time.

2. Participant Waiver and Release

•  Participant Waiver and acknowledged reading of waiver upon payment,  that participation requires full acceptance of the waiver.

• Payment is acknowledgement and agreement to the waiver.

3. Vendor Agreements

Licensing and Permits: Vendors must provide proof of required business licenses, health permits (for food vendors), and liability insurance.

• Food Safety: All food vendors must comply with local health regulations.

• Alcohol Vendors: Breweries and alcohol vendors must adhere to state alcohol laws, including ID verification and responsible serving practices.

• Setup and Cleanup: Vendors are responsible for setting up and dismantling their booths/stalls. State that failure to clean their area may result in additional charges.

• Liability: Vendors assume responsibility for any damages, accidents, or injuries related to their products, services, or equipment.

Vendor Fees and Refund Policy

At Rugged Recess, we value the commitment of our vendors and aim to provide a clear and transparent refund policy. Vendor fees are non-refundable for events that proceed as scheduled, including those held during rain or shine. In the event of unforeseen cancellations or postponements, refunds will only be considered under the following conditions:

• Vendors may request a refund of their fee if the event is canceled or postponed by Rugged Recess at least 30 days prior to the event date.

• Refund requests must be submitted in writing within 7 days of notification of the cancellation or postponement.

Please note, however, that no refunds will be issued for cancellations resulting from force majeure events, such as severe weather, natural disasters, government restrictions, or other circumstances beyond our control.

By registering as a vendor, you acknowledge that you have read and agreed to this policy. Rugged Recess events are designed to proceed in various weather conditions, and refunds will not be issued based on inclement weather. Thank you for your understanding and partnership as we work together to create an unforgettable experience!

4. Venue and Parks Liability

• Indemnification:  Parks, venues, and private property owners are not liability for incidents that occur during the event. Example: “Rugged Entertainment LLC assumes all responsibility for the event, and the park/venue is not liable for damages, injuries, or property loss associated with the event.”

• Permit Compliance: Rugged Entertainment LLC "Rugged Recess" Confirms that all required permits for using public or private spaces are obtained by Rugged Entertainment LLC "Rugged Recess" or other involved parties.

• Damage to Property: Vendors and participants are responsible for any damage caused to the park or venue and will be charged accordingly.

5. Contractor and Employee Agreements

For contractors (e.g., musicians, DJs, event staff) and employees:

• Independent Contractor Acknowledgment: Specify that contractors (musicians, DJs, etc.) are not employees of Rugged Recess LLC and are responsible for their own taxes, insurance, and liabilities.

• Insurance Coverage: Require contractors and performers to carry liability insurance if applicable.

• Payment Terms:  Contracts for contractors/1099 and vendors will outline scope, payment terms, deadlines, and any cancellation fees. Any and all changes to agreements will be documented.

• Conduct and Compliance: Contractors must comply with event policies, safety protocols, and local regulations.

6. Sponsorship and Partner Agreements

• Branding and Marketing: Sponsors must adhere to guidelines for brand placements, co-branded materials, and on-site activation requirements.

• Exclusivity Clauses: If applicable, specify exclusivity rights for certain sponsor categories (e.g., beverage exclusivity for one brewery).

• Liability Disclaimer: Sponsors are not liable for any event-related issues, and vice versa.

7. Safety and Emergency Procedures

• Medical Services:  First aid services will be available on-site but participants assume full responsibility for their health and safety.

• Emergency Protocols: Compliance with Park Permits : Rugged Recess is committed to meeting all park permit requirements, including submitting a tailored Emergency Management Plan to each venue prior to the event. These plans are designed to ensure the safety of attendees, preserve park resources, and comply with local regulations.

Emergency Management Plan

• A comprehensive Emergency Management Plan (EMP) will be provided to each park or venue hosting Rugged Recess events. This plan includes procedures for severe weather, natural disasters, medical emergencies, and other unforeseen situations. The EMP will be tailored to each location and approved by the relevant park authorities before the event.

• Force Majeure Clause: the event may be canceled or rescheduled due to uncontrollable events (e.g., severe weather, pandemics) and that refunds are subject to the terms of the refund policy.

8. Alcohol Consumption

• Responsible Drinking: Participants consuming alcohol are required to drink responsibly. State that intoxicated individuals may be removed from the event for safety reasons.

• Designated Driver Programs:  Attendees are encouraged to arrange safe transportation and Rugged Recess will incentivize designated drivers.

• Alcohol Vendor Responsibilities: Vendors must comply with state and local alcohol laws, including checking IDs and refusing service to intoxicated individuals.

9. Intellectual Property

• Use of Event Name and Branding: The unauthorized use of the Rugged Recess name, logo, and branding for marketing purposes without explicit permission.

• Media Rights All photos and videos taken at the event by Rugged Recess LLC may be used for promotional purposes.

10. Privacy Policy

• Data Collection: Participant and vendor data (e.g., email addresses, registration details) will be collected, stored, and used.

• Third-Party Sharing: No data will be shared with sponsors or third parties.

11. Refund and Cancellation Policy

• Ticket Refunds:ticket sales are final and non-refundable unless the event is canceled by "Rugged Recess".

• Rugged Recess events are Rain or Shine.

• Tickets can be transfer prior to event with ID.

12. Governing Law

• This agreement, and any disputes, claims, or controversies arising out of or relating to participation in Rugged Recess events, shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.

• By participating in Rugged Recess events, all parties agree to comply with all applicable federal, state, and local laws, regulations, and ordinances in the jurisdiction where the event takes place. For events held outside the State of Colorado, the governing laws of the state where the event occurs will apply to all matters related to local operations, permitting, and compliance.

• Any disputes or claims shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado, unless otherwise mandated by the governing laws of the state where the event is held. All parties agree to submit to the jurisdiction of these courts for the resolution of any disputes.

Rugged Recess Code of Conduct

At Rugged Recess: Field Day Forever, we are committed to creating a safe, inclusive, and enjoyable environment for everyone. This Code of Conduct outlines the standards and expectations for all attendees, participants, vendors, sponsors, staff, and volunteers. By participating in Rugged Recess, you agree to uphold these principles and contribute to a positive community experience.

1. Community and Respect

• We believe in fostering a welcoming and inclusive environment where everyone feels valued and respected.

• Treat all individuals with kindness, courtesy, and consideration, regardless of race, ethnicity, gender identity, sexual orientation, religion, disability, or background.

• Celebrate the diversity of our community and actively work to ensure everyone has a memorable experience.

2. Zero Tolerance Policy

Rugged Recess has a zero-tolerance policy for any behaviors that compromise the safety, comfort, or enjoyment of others. This includes, but is not limited to:

• Hate Speech or Discrimination: Offensive language, slurs, or actions targeting individuals or groups based on race, ethnicity, religion, gender identity, sexual orientation, disability, or other protected characteristics.

• Violence or Threats: Physical altercations, intimidation, or verbal threats of harm.

• Harassment: Unwanted attention, sexual advances, or any behavior that makes another individual feel uncomfortable or unsafe.

• Bullying or Intimidation: Aggressive or coercive behavior toward participants, staff, or vendors.

• Theft or Property Damage: Respect the property of others, including event equipment, personal belongings, and vendor setups.

Violators of this policy will be removed from the event without a refund and may be banned from future events.

3. Responsible Behavior

• Alcohol Consumption: If participating in drinking-related activities, consume responsibly and in moderation. Over-intoxication or disruptive behavior will not be tolerated.

• Participation in Games: Follow the rules of each game or activity and respect the decisions of event staff and referees.

• Safety First: Take care of yourself and those around you. Stay hydrated, wear appropriate attire, and be mindful of your physical limits.

• Designated Driver Encouragement: Plan for safe transportation if consuming alcohol. Utilize rideshare services or designated drivers.

4. Vendor and Staff Interaction

• Treat all vendors, sponsors, and staff with respect and professionalism.

• Follow vendor guidelines and policies, and respect their space and property.

• Direct any questions, concerns, or complaints to event staff rather than confronting individuals directly.

5. Environmental Stewardship

• Help us keep the event clean and green! Use designated trash and recycling bins, and dispose of waste responsibly.

• Avoid littering, damaging natural spaces, or disrupting the local environment.

6. Reporting Issues

If you experience or witness any behavior that violates this Code of Conduct, please report it to event staff immediately. You can also contact us at info.ruggedrecessgames@gmail.com or call 720-978-2044 for confidential reporting.

All reports will be taken seriously and addressed promptly. Individuals found in violation of the Code of Conduct may face immediate removal from the event, notification of law enforcement (if applicable), and a permanent ban from future Rugged Recess events.

7. Acknowledgment and Agreement

By attending Rugged Recess, you agree to adhere to this Code of Conduct and to foster a safe, inclusive, and positive environment for all participants. Let’s work together to make Rugged Recess a memorable, meaningful, and fun experience for everyone!
